1. Agreement
By downloading, installing, or using Merge PDF (“the App”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the App. If you are using the App on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
2. What the App does
Merge PDF lets you combine PDFs and photos you choose into one PDF on your device, arrange those pages, and share the finished file. Processing happens on the phone. We do not guarantee that every PDF or image will open, preview, or merge. Very large batches can fail when the device runs out of memory. You are responsible for the files you add and for what you do with the PDF you create.
3. Your files
You keep whatever rights you already have in the documents and photos you add. You confirm you have the right to use that material. We do not claim ownership of your files. The App needs permission only to read the items you pick and to save the merged PDF on the device.
4. Eligibility
You must be old enough to enter a binding contract in your jurisdiction, and at least the age required by Apple or Google for your region, to use the App. If you are under that age, you may not use Merge PDF.
5. License to you
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App for lawful purposes. You may not copy, modify, distribute, sell, lease, or reverse engineer the App except where applicable law expressly permits.
6. Acceptable use
You agree not to:
- Use the App to harass, abuse, defraud, threaten, or impersonate others.
- Create, store, or share material that is illegal, including any child sexual abuse and exploitation (CSAE) or child sexual abuse material (CSAM).
- Circumvent security or probe or attack our or our vendors’ systems.
- Add files you do not have the right to use.
We may suspend or end access if we reasonably believe you have violated these rules or applicable law. See our Child safety standards for additional CSAE prohibitions.
7. Third parties
The App may rely on platform services from Apple or Google, and on Google Analytics for Firebase for usage events described in the Privacy Policy. Those services have their own terms. We are not responsible for third-party failures, changes, or for other apps you use to open or share a PDF.
8. Intellectual property
The App, its name, branding, and underlying software are owned by 540 Makhado Labs or our licensors. These Terms do not grant you any rights to our trademarks or logos except the limited right to refer to the App accurately.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT EVERY FILE WILL MERGE, THAT OUTPUT WILL MATCH THE SOURCE PAGES EXACTLY, OR THAT THE APP WILL BE ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 540 MAKHADO LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM YOUR USE OF THE APP OR ANY FILE IT CREATES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT PAID US ANYTHING.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
11. Indemnity
You will defend and indemnify 540 Makhado Labs and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your files, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
12. Changes
We may modify the App or these Terms. We will post updated Terms with a new effective date. Continued use after changes become effective constitutes acceptance unless applicable law requires a different process.
13. Termination
You may stop using the App at any time by uninstalling it. We may terminate or suspend access with or without notice if we believe it is necessary for legal, security, or operational reasons.
14. Governing law & disputes
These Terms are governed by the laws applicable in the jurisdiction where 540 Makhado Labs is established, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in that jurisdiction have exclusive jurisdiction, subject to those mandatory protections.
